Artscenewest.com is owned by Art Scene West LLC, a limited liability company. Artscenewest.com and our logos are a trademark of Art Scene West LLC. Artscenewest.com is an Online Gallery, Marketplace, and Submissions Service website. All artwork and services are provided by Art Scene West, therefore the customer understands they are interacting with Art Scene West when visiting our Website. Under no instance is the Customer forced to engage in business with Art Scene West against their will, nor pay for artwork, shipping, submission fees, or any other costs related to our services, when visiting Artscenewest.com. Visitors maintain sole discretion of their decision to use and engage in business with Artscenewest.com and are responsible for acknowledging and agreeing to our Terms and Conditions. 

Art Scene West represents Artist’s Artwork throughout our Website and Online Gallery. For all questions regarding the artwork displayed on our Website, the User agrees they shall contact Art Scene West through our Contact Form, or by email at info@artscenewest.com, and not attempt to communicate with the Artist(s) directly. This is to keep our Artist(s) safe from unsolicited emails, spam, and other unwanted communication. Artist(s) whose artwork is displayed on our Website are under a contractual agreement and have given permission to Art Scene West to represent and broker their selected artwork for purposes of sales transactions and transferring ownership of selected artwork, and to facilitate any communication between Customer and the Artist. Art Scene West does not maintain possession of the Artwork available on Artscenewest.com, which resides with the Artist(s). We represent the Artwork available on Artscenewest.com to the best understanding of the information provided to us by the Artist. Customers agree that the details and information we display on our Website regarding Artists Artwork are approximations of the Artwork, and due to limitations in photographic depictions, inconsistencies in information delivery, and human oversight, We do not guarantee exact representation of those Artworks on our website. 

Property

All Artwork images and Artist information related to the Artists and their Artworks on display on Artscenewest.com is property of the Artist who produced the paintings and information. The images and information found on Artscenewest.com shall not be used, reproduced, or replicated without permission from the Artist, which must be obtained through mediation by Art Scene West on behalf of Artist and User, using the Contact Form or the email address: info@artscenewest.com

Website:

All content and images on Artscnewest.com, not directly provided to us by Artists, are the property of Art Scene West LLC. These include, but are not limited to: Exhibitions, Graphic Designs, Events, Promotions, Articles, Blogs, and Interviews. No content, image, or logos found on Artscenewest.com may be used, reproduced, or replicated in any way for private or public use without permissions from Art Scene West.  

Purchases

By making a purchase on Artscenewest.com, you as the Customer affirm you are in agreement with our Terms and Conditions, Privacy Policy, and our Shipping and Return Policies. The Customer also acknowledges any purchases made on our website were by the sole determination of the Customer and/or their party, and they did so willingly and truthfully in accordance with the law. If the Customer wishes to cancel their payment after an Artwork has already been shipped, the Customer will be responsible for paying return shipping charges of the Artwork back to its return destination upon its arrival to them. Shipping and Handling costs are non-refundable. 

Shipping

All artwork purchased on Artscenewest.com is shipped by the Artist directly to the Customer. Under the agreement between Art Scene West and the Artist, the Artist is responsible for professionally serviced packaging and delivery to the Customer’s destination within the time frame We have established to the Customer. Tracking information will be provided to the Customer by Art Scene West once the Artwork is shipped. The Customer shall not make an attempt to contact the Artist directly for any reason, including with concern to shipping and handling of artwork. Customers agree to the limit which Art Scene West is responsible for lost or stolen packages while in transit to the Customer's destination. In the event an Artwork is lost, stolen, or damaged while in transit, the Customer will be refunded the entirety of their purchase, including shipping and handling. Beyond a full refund, the Customer releases Art Scene West from further liability in the event of a lost, stolen, or damaged Artwork purchased on Artscenewest.com and intended for their destination. Art Scene West, nor our Artists, are responsible for stolen packages after the artwork is delivered to the destination. All questions and concerns by Customers regarding shipping and handling, or overall quality of the Artwork that is delivered, should be addressed to Art Scene West through our Contact Form or at info@artscenewest.com and not the Artists themselves. Photographic evidence must be produced for Artworks that are damaged upon arrival. If a package or artwork appears damaged, take photographs of the damaged package, as well as the damaged Artwork itself, and include them in your return email as evidence. 

Returns 

Customers have 14 days from the date the painting is delivered to their destination to make a return, so long as the Customer provides proof the Artwork is in transit to its return destination within this time frame. A refund will be issued once the Artwork has been delivered to its return destination and determined to be in acceptable condition. Penalties for artworks not damaged upon arrival that are returned in less-than-satisfactory condition will result in deductions from the Customers Refund, determined by the Artist according to the cost-for-labor-and-supplies required to repair or re-touch the artwork to bring it back to its valued quality. Shipping and handling costs are non-refundable. Please allow up to 7 business days for the refund to process. To make a return, the Customer shall first email Art Scene West at info@artscenewest.com, with the word RETURN, in the subject line, followed by their INVOICE NUMBER. An example is below.

Art Scene West will reply to the Customer’s email with shipping details for the Customer to address the return package to. All return shipping and packaging is the responsibility of the Customer to pay.

Art Scene West, LLC (“Art Scene West”) (which is referred to in this Privacy Policy by the terms Us, Our, Gallery, Website, or www.artscenewest.com) seeks transparency and trust with our website visitors and customers. By using www.artscenewest.com, you are agreeing to the Privacy Policy outlined below, which is provided to you in reference to your legal rights and responsibilities.

Art Scene West collects information in the form of your unique IP address, which is a unique string of characters that identifies each computer using the Internet Protocol to communicate over a network. This information is gathered in our Analytics and used to determine how visitors are interacting with our website; such as the frequency and duration our different web pages are visited.  This helps us improve our website and better understand user experience.

Art Scene West uses 3rd party payment services including: 1.) Stripe and 2.) Paypal, to process all monetary transactions on www.artscenewest.com. Art Scene West does not collect the personal information you provide to these services when you agree to make a transaction on our Website, and therefore we are providing the Privacy Policies of these two services here for your consideration.

Artscenewest.com collects certain information from you when you 1.) agree to make a purchase from our Website 2.) fill out a contact form 3.) email us directly 4.) request to be included in our mailing lists 5.) submit to one of our Call for Artists or 6.) by any other methods not previously mentioned. 

This information includes your first and last name, email address, and phone number. This information is stored by Art Scene West for the purpose of communicating with you regarding your purchase(s), answering your question(s), and for providing you with information, not limited to, our Call for Artists, Online Gallery, Artist Opportunities, Exhibitions, Events, and similar announcements regarding our Gallery and its happenings. All communication received from Art Scene West will be relevant to the nature of our Gallery and its happenings. Your personal information will never be used, sold or shared to any third party by Art Scene West, outside of fulfilling your agreement to the Gallery, i.e., in securing and processing payment for our products and services, in which one of the two payment processing companies listed above will be used.  

You have the right to be removed from our email lists and from our website database altogether, eliminating all communication between Art Scene West and yourself, by simply sending an email with your request for Us to do so. At any time, you also have the right to re-submit to our email newsletter and reestablish communication at your will, should that be your desire. 

Indemnify

User agrees to indemnify, defend, and hold harmless Art Scene West from any claim or demand, including attorney’s fees, made by any third party due to or arising out of Users breach of the Terms of Service or Users violation of any law or the rights of a third party.
